General

These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all legal transactions concluded via the online platform www.dermacompetencecare.com (hereinafter referred to as “dcc Shop”). The operator of the dcc Shop is derma competence center ag, Bodmerstrasse 4, 8002 Zurich, Switzerland (hereinafter referred to as “dcc-ag”).

1. CONTRACT CONCLUSION

Orders are placed via the website www.dermacompetencecare.com after the customer has registered and accepted the present general terms and conditions (AGB). Orders will be confirmed to customers via email. A contract between the customer and dcc Shop is only established with the confirmation of the order. dcc Shop is free not to accept orders and to refuse their confirmation.

2. PRODUCTS

Product information on dcc Shop is non-binding and no liability is assumed for the accuracy, completeness, or timeliness of the information. Information may be changed at any time by dcc-ag. Similarly, quality standards, ingredients, origin information, samples and product trials are non-binding and may be changed at any time.

3. PRICING INFORMATION

All prices are in Swiss Francs and include VAT. For deliveries abroad, the VAT of the respective county is added. The prices apply to the unpacked goods and do not include shipping costs.

For orders with an “invoice” payment method, we reserve the right, after conducting a credit check, to request an alternative payment method (e.g., “advance payment”).

Prices are subject to change at any time.

4. ORDERS

Orders are placed online on the Internet ordering page of the dcc Shop. The offers in the dcc-ag online shop are merely an invitation to submit an offer.

The customer’s order is binding for them. The customer is responsible for the online order and the order is processed by dcc-ag as it is received without further consultation with the customer.

dcc-ag is free to reject the processing of an order at any time without providing reason. In this case, dcc-ag informs the customer. A purchase contract is only concluded when dcc-ag ships the ordered products or confirms shipping to the customer.

dcc-ag assumes no liability for transmission errors or input errors on the customer’s PC.

5. AVAILABILITY

dcc-ag does not guarantee the availability of ordered products and reserves the right to not deliver ordered items, e.g., if they are not available or not fully deliverable. dcc-ag will inform customers about any items that are not available and therefore not delivered. Items that are not delivered will not be sent by dcc-ag once they become available and customers must reorder them if desired.

dcc-ag reserves the right to make substitutions for the ordered products in the event that a product is temporarily unavailable, and another available product has equivalent properties to the one ordered.

6. DELIVERY TERMS

Delivery of ordered items is made to Switzerland and the Principality of Lichtenstein.

The delivery time depends on the circumstances. Delivery dates and deadlines are non-binding approximate times. The customer cannot derive any rights from their non-compliance.

The customer is obliged to accept and pay for the goods.

Delivery takes place with Swiss Post. The estimated delivery date for deliveries to Switzerland and the Principality of Liechtenstein can be found on the respective product page.

Compensation for late delivery is excluded.

7. PAYMENT / CREDIT CHECK

The customer has access to the payment methods available on dcc Shop.

The customer agrees to pay the invoiced amount within 30 days from the invoice date. If the invoice is not settled within the mentioned payment period, the customer will receive a reminder. If the invoice is not settled by the customer within the specified reminder period, the customer automatically enters into default. From the point of default, the customer owes default interest at a rate of 5%.

dcc-ag reserves the right to request advance payment without providing reasons at any time. dcc-ag has the right to refuse the provision of services or the delivery of products in case of payment default.

For online payments or purchases on advance payment terms, the provision of services or the delivery of products will only take place one the corresponding payment has been received by dcc-ag.

Offsetting the invoiced amount against any claim the customer may have against dcc-ag is not permissible.

8. RIGHT OF WITHDRAWAL AND RETURN OF GOODS

Goods received by the customer as a result of their order can be returned to dcc-ag within 14 days of receipt without stating any reasons, provided that the goods are unused, in their original packaging, and in perfect condition. The return of the goods is considered a withdrawal from the order. The return of the goods is at the expense, liability, and risk of the customer, unless there is a mistake on the part of dcc-ag. The right of withdrawal does not apply to goods that are made to the customer’s special specifications, are perishable, or have exceeded their expiration dates.

For the refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you.

9. RESERVATION OF OWNERSHIP

Until full payment of the price as well as all associated costs, including default interest, the goods ordered by the customer remain the property of dcc-ag.

If the customer is in default with the payment of the purchase price, dcc-ag is entitled to withdraw from the contract and take possession of the goods without further notice.

10. DISCLAIMER AND WARRANTY

dcc-ag assumes no liability for errors in images, prices, texts or for delayed or non-delivery.

Upon handover of the goods to the carrier, dcc-ag has fulfilled all obligations arising from the customer’s order, and the ownership and risk regarding the goods are transferred to the customer. In particular, dcc-ag is not liable in the event that the carrier does not deliver the goods directly to the customer but deposits the goods in the front of the customer’s door, with a neighbor, or similar manner in the customer’s absence.

The customer is obligated to inspect the goods immediately upon receipt and to notify dcc-ag of any defects in writing within seven days of receiving the goods. In the case of defects, the customer has the right to demand a replacement delivery or a reduction in the purchase price, with these rights not applicable to minor defects. In all other respects, any warranty on the part of dcc-ag is waived to the extent legally permissible.

Furthermore, dcc-ag does not provide any guarantee in connection with its website, neither for its content nor for the availability of the website to the customer or third parties.

11. DATA PROTECTION

Detailed information about the nature, scope, and purpose of the collection, processing, and use of personal data required for order processing by dcc-ag is provided in the privacy policy.

12. CHANGES TO THE TERMS AND CONDITIONS

Unilateral changes to these terms and conditions by dcc Shop are reserved, and the version published on the website at the time of contract conclusion applies.

13. SEVERABILITY CLAUSE

If individual provisions of these terms and conditions are wholly or partially invalid, the validity of the remaining provisions shall not be affected. The respective legal provisions shall apply in the place of the invalid provisions.

14. APPLICABLE LAW AND JURISDICTION

The legal relationship between the customer and dcc-ag is subject to substantive Swiss law, excluding the Vienna Sales Convention (CISG). The place of jurisdiction is Zurich, with dcc-ag also having the right to file a lawsuit at the customer’s place of residence. The registered office of dcc-ag is the place of performance.
